The legal text below is in English. The English text is the binding version.
This website (the "Site", reachable at [site domain] and any page that links to these Terms) is operated by NWXT Entertainment ("NWXT ENT.", "we", "us"), the music label formerly known as FWLX Media & Entertainment, owned by Yuna Asakura and Andrei Alexandru Toma and registered as [legal entity name], [company / VAT number], [registered address].
These Terms of Service (the "Terms") are a legally binding agreement between you and us about your use of the Site. By opening, browsing or otherwise using the Site you accept these Terms and our Privacy Policy. If you do not agree with them, please do not use the Site.
The Site presents the label, its artists and its releases. It does not sell anything, does not offer user accounts and does not host user-generated content. If we add such features later (for example a shop, a newsletter, comments or contests), additional terms may apply and will be shown to you at that point.
The Site is meant for a general audience. If you are under the age at which you can agree to terms like these in your country (16 in most of the European Union, 13 in the United States), you may only use the Site with the permission of a parent or guardian, who then accepts these Terms on your behalf. We do not knowingly collect personal data from children; see the Privacy Policy.
You may not use the Site if you have previously been blocked from it by us, or if doing so would be unlawful where you are.
We provide the Site free of charge, for information and entertainment. We may add, change, pause or remove any part of it at any time, without notice and without liability to you, including artist pages, releases, visual designs, languages and any interactive feature. Release dates, titles, line-ups and other details shown on the Site may change before or after publication.
Parts of the Site may be labelled as placeholders, previews or works in progress. Such content is provided for illustration only and is not an offer, promise or commitment of any kind.
Everything on the Site is protected by copyright, trade mark, design, database and other intellectual property laws. This includes, without limitation: the NWXT wordmark and logos, the name NWXT ENT. and its former name FWLX Media & Entertainment, the artist names and stage names, the photographs, cut-outs and likenesses of the artists (used with their permission), the artwork and covers of the releases, all music, audio, video, lyrics, texts, biographies, lore, layouts, animations, graphics, fonts (used under their respective licences), colour schemes, source code and the overall look and feel of the Site. All of it is owned by us or by our licensors, and all rights not expressly granted to you are reserved.
We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to view the Site and its content in your browser for your own personal, non-commercial use. You are welcome to share links to the Site and to our official pages on streaming and social platforms.
Press, promoters, partners and fans who would like to use any material beyond this licence can ask us for permission at [contact e-mail]. Permission is only valid when given in writing.
When using the Site you agree not to:
We may investigate breaches and take any action we consider appropriate, including blocking access and reporting to the authorities.
The Site links to official profiles and releases on third-party platforms such as YouTube, Spotify, TikTok, Instagram, Apple Music, SoundCloud and X, and may link to other sites. Those platforms and sites are not operated by us. When you follow a link you leave the Site, and the terms and privacy policies of the platform you land on apply. We are not responsible for their content, availability, security or practices, and a link does not mean that we endorse a platform or that it endorses us.
Streaming a song, following an artist or buying a ticket or product on a third-party platform is a transaction between you and that platform.
We are happy that people want to work with us. To keep things fair for everyone, the following applies to anything you send us that we did not expressly ask for — demos, songs, lyrics, beats, artwork, videos, ideas, concepts, business proposals and similar material ("Submissions"):
Feedback, suggestions and ideas about the Site itself may be used by us freely and without any obligation to you.
The Site and its content are provided "as is" and "as available", without any warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability or freedom from errors or viruses. We do not promise that the Site will be uninterrupted, secure or error-free, that defects will be corrected, or that the information on it (including biographies, dates and credits) is complete or up to date.
Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under the law that applies to you, in particular the statutory rights of consumers in the European Union, the United Kingdom and elsewhere.
To the fullest extent permitted by law:
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any other liability that cannot be excluded or limited by applicable law. If you are a consumer, nothing in these Terms affects the mandatory consumer-protection rules of the country in which you live.
If you are using the Site on behalf of a business or other organisation, that organisation agrees to indemnify and hold us, our owners, staff, artists and partners harmless from any claim, loss, liability, damage, cost or expense (including reasonable legal fees) arising from its or its users' breach of these Terms or misuse of the Site or its content. If you are a consumer, you are responsible for the damage you cause us through a breach of these Terms only as far as the law of your country allows.
We may suspend or terminate your access to all or part of the Site at any time, with or without notice, if we reasonably believe that you have breached these Terms or the law, or to protect the Site, its users, the label or its artists. Sections 4, 7, 8, 9, 10, 12 and 13 survive any termination.
We may update these Terms from time to time, for example when we add features to the Site or when the law changes. The current version, with its effective date and version number, is always available on this page. Material changes take effect when the updated Terms are published here; if a change is significant we will make it visible on the Site for a reasonable time. By continuing to use the Site after a change takes effect you accept the updated Terms.
These Terms, and any dispute or claim arising out of or in connection with them or with the Site (including non-contractual disputes), are governed by the laws of [country — Belgium unless you decide otherwise], without regard to its conflict-of-law rules. The courts of [city of the competent courts] have exclusive jurisdiction, except that:
If something goes wrong, please contact us first at [contact e-mail]: most issues can be solved without lawyers. We are neither obliged nor willing to take part in dispute-resolution proceedings before a consumer arbitration board unless the law requires it.
